1. Introduction

These Terms and Conditions set out the basis upon which Alec Amos, trading as Wimbledon Plumbing Services ("Wimbledon Plumbing Services", "we", "us" or "our"), agrees to supply plumbing, heating, gas, bathroom installation, repair, servicing and related services to domestic and commercial customers.

These Terms apply to every quotation, estimate, booking and instruction unless otherwise agreed in writing.

By accepting a quotation, requesting attendance, instructing us to begin work, paying a deposit or permitting work to commence, you confirm that you have read and accepted these Terms and Conditions. Headings are for convenience only and do not affect interpretation.

Nothing within these Terms affects your statutory rights.

2. Definitions

For the purposes of these Terms:

The “Business” means Alec Amos trading as Wimbledon Plumbing Services.

The “Customer” means the individual, company, landlord, managing agent or other person instructing Wimbledon Plumbing Services to carry out work.

The “Engineer” means Alec Amos or any employee, subcontractor or suitably qualified tradesperson engaged by Wimbledon Plumbing Services.

“Property” means the address where the work is to be carried out.

“Estimate” means an indication of likely cost only and is not contractually binding.

“Works” means all labour, installation, servicing, repair, testing, inspection, maintenance, bathroom installation, gas work, plumbing work, heating work and any related services supplied.

“Materials” means all fixtures, fittings, appliances, boilers, valves, pipework, controls, consumables and other goods supplied for the Works.

“Emergency Call-Out” means work requested outside normal working hours or requiring immediate attendance.

“Rates Schedule” means the current schedule of labour rates, call-out charges and additional charges published by Wimbledon Plumbing Services or otherwise supplied to the Customer.

3. Formation of the Contract

A contract between Wimbledon Plumbing Services and the Customer is formed when any one of the following occurs:

  • a written quotation is accepted;

  • a deposit is paid;

  • the Customer instructs Wimbledon Plumbing Services to proceed;

  • work commences at the Property;

  • an emergency attendance is requested.

Instructions may be given verbally, by email, by text message or through any other agreed communication method.

Electronic acceptance shall carry the same contractual effect as a signed agreement.

These Terms apply to every contract unless expressly varied in writing.

4. Quotations and Estimates

4.1 Estimates

Any estimate is provided as a genuine indication of anticipated cost based upon the information available at the time.

An estimate is not a fixed price and does not constitute a binding offer.

The final cost may differ where:

  • additional faults become apparent;

  • further work proves necessary;

  • the Customer changes the scope of work;

  • access restrictions increase labour time;

  • concealed defects are discovered;

  • material prices change before work begins.

4.2 Written Quotations

A written quotation sets out the work that Wimbledon Plumbing Services has agreed to undertake together with the price for those works.

Unless otherwise stated, quotations remain valid for 30 days from the date of issue.

We reserve the right to withdraw or amend any quotation before acceptance where:

  • supplier prices change significantly;

  • specification errors are identified;

  • information supplied by the Customer proves inaccurate;

  • circumstances materially affecting the work change.

4.3 Scope of Quotations

A quotation covers only the work specifically described within it.

Unless expressly stated, quotations do not include:

  • decorating;

  • plastering;

  • tiling;

  • flooring;

  • carpentry;

  • electrical work carried out by others;

  • structural alterations;

  • asbestos removal;

  • specialist surveys;

  • reinstatement of finishes;

  • making good beyond that reasonably necessary to complete our plumbing or heating work.

Where additional works become necessary, these will be discussed with the Customer before proceeding wherever reasonably practicable.

4.4 Variations

If the Customer requests additional work after a quotation has been accepted, the additional work shall be charged separately.

This may be:

  • at the current hourly rate;

  • under a revised quotation; or

  • at another agreed fixed price.

Verbal instructions given by the Customer during the course of the Works authorise Wimbledon Plumbing Services to carry out those additional works and charge accordingly.

4.5 Unforeseen Conditions

Plumbing and heating systems are frequently concealed behind walls, beneath floors, inside ceilings or within cupboards.

Accordingly, Wimbledon Plumbing Services cannot accept responsibility for conditions which could not reasonably have been identified before work commenced.

Examples include, but are not limited to:

  • hidden leaks;

  • defective pipework;

  • seized valves;

  • corroded fittings;

  • unsafe gas installations;

  • defective electrical supplies;

  • rotten floor timbers;

  • concealed structural defects;

  • asbestos-containing materials;

  • inadequate water pressure;

  • damaged drains;

  • historic poor workmanship.

Where such conditions are discovered, work may need to be paused until revised costs have been agreed.

 

4.6 Customer Information

Quotations are prepared using information supplied by the Customer together with any inspection undertaken before the quotation is issued.

The Customer is responsible for ensuring that all information supplied is complete and accurate.

If relevant information is withheld or later proves inaccurate, Wimbledon Plumbing Services reserves the right to revise the quotation accordingly.

4.7 Gas Appliances

Where gas appliances are commissioned, serviced or replaced, Wimbledon Plumbing Services may be required, as part of its duties under Gas Safe Regulations, to inspect other connected gas appliances or associated installations where necessary to confirm the safety of the installation.

Should unsafe situations or defects be identified, Wimbledon Plumbing Services may classify the installation in accordance with current Gas Safe requirements and advise the Customer of any remedial works required.

Safety obligations shall always take precedence over completion of the requested work.

5. Rates, Charges and Payment for Works

5.1 Fixed Price Works

Where Wimbledon Plumbing Services provides a written quotation for a fixed price, that price applies only to the work expressly described within the quotation.

Unless otherwise stated, the quoted price includes labour and the materials specifically identified in the quotation but excludes any additional work arising from unforeseen circumstances or requested by the Customer after acceptance.

Should additional works become necessary, the Customer will be informed as soon as reasonably practicable. Where possible, a revised quotation or estimate will be provided before those works are undertaken.

5.2 Hourly Rate Works

Where no fixed-price quotation has been accepted, work shall be charged on a time and materials basis.

Charges will comprise:

  • Labour at the current hourly rate shown in the Rates Schedule;

  • The cost of materials supplied;

  • Any additional charges applicable under these Terms.

Labour charges include not only the time spent carrying out work at the Property but also the reasonable time required for:

  • collecting materials;

  • obtaining specialist components;

  • travelling where applicable;

  • testing and commissioning installations;

  • completing mandatory certification;

  • administration directly relating to the Works.

5.3 Labour Charges

Labour is charged using the rates current at the date the work is undertaken.

Time is normally calculated from arrival at the Property until completion of the visit.

Where the Customer requests attendance at another location before arriving at the Property (for example to collect keys), or where significant travel is required solely because of the Customer's instructions, reasonable additional time may be charged.

The Rates Schedule forms part of these Terms and Conditions.

5.4 Emergency Call-Outs

Emergency call-outs requested outside normal working hours shall be charged at the emergency rates shown within the Rates Schedule.

Emergency attendance does not guarantee that permanent repairs can be completed during the initial visit.

Where specialist parts or further works are required, temporary measures may be implemented where safe and appropriate until permanent repairs can be arranged.

5.5 Materials

Materials supplied by Wimbledon Plumbing Services shall be charged at the agreed price or, where no fixed price has been agreed, at the purchase cost plus a reasonable handling charge reflecting:

  • sourcing;

  • collection;

  • transportation;

  • storage;

  • administration;

  • warranty handling.

Should supplier prices increase after a quotation has been issued but before materials have been ordered, Wimbledon Plumbing Services reserves the right to revise the quotation accordingly after discussing the change with the Customer.

 

5.6 Customer-Supplied Materials

Where the Customer requests that materials or appliances supplied by them are installed, Wimbledon Plumbing Services accepts no responsibility for:

  • incorrect specification;

  • manufacturing defects;

  • compatibility issues;

  • delays caused by missing components;

  • warranty claims relating to those items.

If customer-supplied materials prove unsuitable or defective, additional labour and attendance required to rectify the issue shall be chargeable.

5.7 Additional Charges

In addition to labour and materials, Wimbledon Plumbing Services reserves the right to recover reasonable costs incurred in connection with the Works, including where applicable:

  • parking charges;

  • residents' parking permits;

  • congestion or clean air zone charges;

  • tolls;

  • courier or special delivery costs;

  • supplier delivery charges;

  • specialist waste disposal charges;

  • restocking charges imposed by suppliers;

  • hire of specialist equipment;

  • third-party certification fees.

These charges will only be applied where reasonably incurred.

 

5.8 Abortive Visits

If Wimbledon Plumbing Services attends an agreed appointment and is unable to commence or continue work due to circumstances outside its control, reasonable charges may be made.

Examples include:

  • no access to the Property;

  • the Customer not being present;

  • utilities disconnected;

  • unsafe working conditions;

  • incorrect appointment information;

  • essential materials unavailable due to Customer instructions.

Charges may include labour, travel time and any costs already incurred.

 

5.9 Cancellations

Appointments cancelled with less than 24 hours' notice may be subject to a cancellation charge reflecting the time reserved and any costs already incurred.

Where materials have already been purchased specifically for the Works, the Customer shall remain responsible for those costs unless the materials can be returned without penalty.

Special order or bespoke items which cannot be returned remain payable in full.

 

5.10 Deposits

Wimbledon Plumbing Services reserves the right to request a deposit before commencing work.

Deposits may be required for, including but not limited to:

  • boiler installations;

  • bathroom installations;

  • works involving bespoke or special-order materials;

  • larger projects;

  • works requiring significant advance expenditure.

No obligation to commence work arises until any requested deposit has been received.

 

5.11 Stage Payments

For larger projects extending over more than one day, Wimbledon Plumbing Services may require interim payments as work progresses.

The timing and amount of stage payments will be agreed before work commences.

Failure to make an agreed stage payment may result in work being suspended until payment has been received.

 

5.12 Payment

Unless otherwise agreed in writing, payment becomes due immediately upon completion of the Works and presentation of an invoice.

Invoices may be issued:

  • following completion of the work;

  • at agreed project milestones;

  • upon delivery of significant materials;

  • before final completion where stage payments have been agreed.

As Wimbledon Plumbing Services is not VAT registered, VAT is not charged on invoices unless this position changes in the future.

 

5.13 Late Payment

If payment is not received by the due date, Wimbledon Plumbing Services reserves the right to charge interest on the outstanding balance at a rate of 4% above the Bank of England base rate, calculated daily until payment is made in full.

The Customer shall also be responsible for any reasonable costs incurred in recovering overdue sums, including court fees, debt recovery charges and legal costs where recoverable by law.

 

5.14 Suspension of Work

Where any invoice remains unpaid after its due date, Wimbledon Plumbing Services reserves the right to suspend further work until all outstanding amounts have been settled.

Any delay resulting from suspended works shall not constitute a breach of contract by Wimbledon Plumbing Services.

 

6. Customer Responsibilities and Access to the Property

 

6.1 Customer Responsibilities

The Customer is responsible for ensuring that Wimbledon Plumbing Services is provided with all information reasonably required to carry out the Works safely and efficiently.

This includes, where applicable:

  • details of known defects within the plumbing, heating or gas installation;

  • previous repair work carried out by third parties;

  • known leaks or recurring faults;

  • the presence of asbestos or other hazardous materials;

  • restricted access arrangements;

  • pets or animals that may affect safe working;

  • any circumstances that may impact the safe completion of the Works.

Where information is withheld or is inaccurate, Wimbledon Plumbing Services shall not be responsible for delays, additional costs or losses arising directly from that omission.

 

6.2 Authority to Instruct Work

The person instructing Wimbledon Plumbing Services confirms that they are either:

  • the owner of the Property;

  • a tenant with authority to instruct the Works;

  • a landlord;

  • a managing agent; or

  • otherwise authorised to enter into a contract for the Works.

Where instructions are given on behalf of another person or organisation, the individual placing the order remains jointly and severally liable for payment unless Wimbledon Plumbing Services has expressly agreed otherwise in writing before work commences.

 

6.3 Access to the Property

The Customer shall provide safe and uninterrupted access to all areas reasonably required to complete the Works.

This includes access to:

  • water supplies;

  • gas supplies;

  • electrical supplies;

  • stopcocks;

  • boilers;

  • cylinders;

  • consumer units where relevant;

  • loft spaces;

  • meter cupboards;

  • service ducts;

  • external drainage where applicable.

Failure to provide suitable access may result in additional charges or the postponement of the Works.

 

6.4 Working Area

Before work commences, the Customer shall take reasonable steps to remove or protect:

  • furniture;

  • valuable possessions;

  • electrical equipment;

  • fragile items;

  • decorations;

  • floor coverings;

  • personal belongings.

Although reasonable care will always be taken, Wimbledon Plumbing Services accepts no responsibility for damage to items left within the immediate working area where their removal was reasonably practicable.

 

6.5 Utilities

The Customer shall ensure that suitable supplies of water, electricity and, where applicable, gas are available for the duration of the Works unless otherwise agreed.

Where utilities are unavailable or disconnected, Wimbledon Plumbing Services reserves the right to suspend work until adequate services are restored.

 

6.6 Safe Isolation of Services

Where necessary to carry out the Works safely, Wimbledon Plumbing Services may temporarily isolate:

  • water supplies;

  • gas supplies;

  • electrical supplies;

  • heating systems.

Reasonable notice will normally be given unless immediate isolation is necessary to prevent injury or damage.

 

6.7 Health and Safety

Wimbledon Plumbing Services reserves the right to refuse to commence or continue work where, in its reasonable opinion, working conditions present an unacceptable risk to health or safety.

Examples include, but are not limited to:

  • suspected gas leaks;

  • unsafe electrical installations;

  • structural instability;

  • flooding;

  • exposure to hazardous substances;

  • vermin infestation;

  • aggressive behaviour;

  • abusive language;

  • threatening conduct;

  • illegal activity at the Property.

Where work cannot safely proceed, charges may still apply for attendance, time spent on site and any costs already incurred.

 

6.8 Children and Pets

The Customer is responsible for ensuring that children, pets and other occupants do not interfere with the Works or enter areas where work is taking place.

Wimbledon Plumbing Services accepts no responsibility for injury arising from failure to supervise children or animals during the course of the Works.

 

6.9 Parking

Where parking restrictions apply, the Customer should make reasonable arrangements to provide lawful parking as close to the Property as possible.

If parking permits, visitor permits or suspended parking bays are required, these should normally be arranged by the Customer before the appointment.

Where paid parking is the only option, the reasonable cost shall be recoverable in accordance with these Terms.

 

6.10 Delays Outside Our Control

Wimbledon Plumbing Services shall not be liable for delays arising from circumstances beyond its reasonable control, including but not limited to:

  • traffic disruption;

  • severe weather;

  • supplier shortages;

  • manufacturer delays;

  • industrial action;

  • utility failures;

  • road closures;

  • public emergencies;

  • delays in obtaining specialist parts.

Appointment times are therefore estimates only unless expressly agreed otherwise.

 

6.11 Existing Installations

Many plumbing and heating systems contain ageing components that may be brittle, corroded or otherwise nearing the end of their serviceable life.

The Customer acknowledges that work carried out on one part of an existing system may expose weaknesses elsewhere that could not reasonably have been identified beforehand.

Accordingly, Wimbledon Plumbing Services shall not be liable where:

  • existing valves fail during normal operation;

  • aged pipework develops leaks following lawful pressure testing;

  • obsolete fittings cannot be removed without damage;

  • previously concealed defects become apparent;

  • historic workmanship by others contributes to further failures.

Where such issues arise, Wimbledon Plumbing Services will advise the Customer and, where requested, provide a quotation for any additional remedial work.

 

6.12 Concealed Defects

The Customer acknowledges that plumbing, heating and drainage installations are frequently concealed behind finishes or beneath floors.

Until these areas are exposed, Wimbledon Plumbing Services cannot reasonably determine the full condition of the installation.

If concealed defects are discovered, including but not limited to:

  • damaged pipework;

  • rotten timbers;

  • structural defects;

  • asbestos-containing materials;

  • unsafe wiring;

  • inadequate support;

  • non-compliant gas installations;

  • hidden water damage;

the original quotation may require revision.

No liability shall attach to Wimbledon Plumbing Services for delays or additional costs resulting directly from such concealed conditions.

 

6.13 Making Good

Unless expressly included within a quotation, Wimbledon Plumbing Services is responsible only for making good those areas reasonably necessary to complete its plumbing, heating or gas work.

The following are not included unless specifically agreed:

  • plastering;

  • decorating;

  • tiling;

  • flooring;

  • joinery;

  • brickwork;

  • specialist finishes;

  • landscaping;

  • replacement of bespoke finishes.

Where requested, Wimbledon Plumbing Services may arrange such works through suitably qualified third parties, but these shall be chargeable separately.

 

6.14 Customer Cooperation

The Customer agrees to cooperate reasonably throughout the Works.

Where repeated instructions, delays or interruptions by the Customer materially affect progress, Wimbledon Plumbing Services reserves the right to charge for additional time reasonably incurred.

 

7. Materials, Guarantees and Liability

 

7.1 Supply of Materials

Unless otherwise agreed in writing, Wimbledon Plumbing Services shall supply all materials required to complete the Works.

All materials supplied will, so far as reasonably practicable, be suitable for their intended purpose and sourced from reputable manufacturers or suppliers.

Where specified products become unavailable due to circumstances beyond our control, we reserve the right to substitute products of equivalent quality and specification after consulting the Customer.

 

7.2 Customer-Supplied Goods

Where the Customer requests the installation of goods supplied by them or by a third party on their behalf, Wimbledon Plumbing Services accepts no responsibility for:

  • the suitability of those goods;

  • manufacturing defects;

  • compatibility with existing systems;

  • missing parts or accessories;

  • delays arising from incorrect or incomplete deliveries;

  • warranty claims relating to those goods.

Any additional labour required as a result of defective or unsuitable customer-supplied materials shall be chargeable.

Where installation cannot proceed because customer-supplied goods are unsuitable, attendance and labour charges shall remain payable.

 

7.3 Ownership of Materials

Ownership of all materials supplied by Wimbledon Plumbing Services shall remain with Wimbledon Plumbing Services until payment has been received in full for:

  • all materials supplied; and

  • all associated labour and charges.

Until ownership passes, the Customer shall not sell, remove, dispose of or otherwise deal with those materials except in the ordinary use of the Property.

 

7.4 Risk

Risk in materials shall pass to the Customer immediately upon delivery to the Property.

The Customer is responsible for ensuring that materials delivered to site are adequately protected against theft, damage or misuse.

 

7.5 Removal of Unpaid Materials

Where payment remains outstanding after becoming due, Wimbledon Plumbing Services reserves the right, where lawful and reasonably practicable, to recover materials that remain its property.

Reasonable notice will normally be given before any attempt is made to recover such materials.

Nothing within this clause affects any other legal remedy available for recovery of outstanding sums.

8. Workmanship Guarantee

 

8.1 Our Guarantee

Subject to these Terms and Conditions, Wimbledon Plumbing Services provides a 12-month workmanship guarantee on labour carried out by us.

This guarantee applies only to defects arising directly from faulty workmanship.

It does not extend to normal wear and tear, accidental damage, misuse or defects unrelated to the work undertaken.

 

8.2 Notification of Defects

If the Customer believes that work carried out by Wimbledon Plumbing Services is defective, they must notify us as soon as reasonably practicable after becoming aware of the issue.

Notification should normally be made in writing by email or letter and should include sufficient detail to allow the issue to be investigated.

 

8.3 Right to Inspect

Before any claim under the workmanship guarantee can be considered, Wimbledon Plumbing Services shall be given a reasonable opportunity to inspect the alleged defect.

Where appropriate, we may arrange a mutually convenient appointment to examine the work.

If, following inspection, the defect is found to arise from our workmanship, we shall rectify the defect without additional labour charge.

 

8.4 Rectification

Our obligation under this guarantee is limited to repairing or correcting defective workmanship.

The guarantee does not entitle the Customer to:

  • a refund;

  • compensation;

  • replacement of unrelated installations;

  • reimbursement for work undertaken by another contractor without our prior written agreement.

 

8.5 Manufacturer's Warranties

Many products supplied by Wimbledon Plumbing Services carry warranties provided by their manufacturer.

These warranties remain entirely separate from our workmanship guarantee.

Where a manufacturer's warranty applies, Wimbledon Plumbing Services will, where reasonably practicable, assist the Customer in making contact with the manufacturer or supplier.

However, Wimbledon Plumbing Services is not responsible for:

  • decisions made by manufacturers;

  • delays in warranty claims;

  • replacement times;

  • manufacturer inspection procedures.

 

8.6 Boiler Manufacturers

Where a boiler or appliance is supplied with a manufacturer's warranty, it remains the Customer's responsibility to:

  • comply with servicing requirements;

  • maintain the appliance in accordance with the manufacturer's instructions;

  • retain warranty documentation;

  • ensure annual servicing is carried out where required.

Failure to comply with manufacturer requirements may invalidate the manufacturer's warranty.

 

8.7 Circumstances Excluded from the Guarantee

The workmanship guarantee shall not apply where defects arise wholly or partly from:

  • work altered by another contractor;

  • customer interference;

  • misuse;

  • accidental damage;

  • lack of maintenance;

  • freezing;

  • vandalism;

  • flooding;

  • structural movement;

  • defective existing installations;

  • customer-supplied materials;

  • manufacturer defects;

  • fair wear and tear.

 

8.8 Existing Systems

Many repairs involve working on existing plumbing or heating systems that may be several years old.

While every reasonable effort will be made to complete repairs successfully, Wimbledon Plumbing Services cannot guarantee the future reliability of components that have not been replaced.

Replacement of one component does not constitute a guarantee of the entire system.

 

8.9 Older Installations

Where work is carried out on installations that are approaching or have exceeded their expected service life, Wimbledon Plumbing Services accepts no responsibility for failures occurring elsewhere within the system that are unrelated to our workmanship.

9. Limitation of Liability

 

9.1 Reasonable Skill and Care

Wimbledon Plumbing Services will carry out all work using reasonable skill and care and in accordance with applicable legislation and recognised industry standards.

 

9.2 Scope of Liability

Our liability is limited to losses that are reasonably foreseeable as a direct consequence of our breach of contract or negligence.

We shall not be liable for indirect or consequential losses, including but not limited to:

  • loss of profit;

  • loss of business;

  • loss of rental income;

  • loss of opportunity;

  • inconvenience;

  • additional accommodation costs,

except where such liability cannot lawfully be excluded.

 

9.3 Existing Defects

Wimbledon Plumbing Services accepts no responsibility for defects arising from:

  • historic poor workmanship;

  • ageing systems;

  • corrosion;

  • hidden defects;

  • defective installations completed by others;

  • deterioration of existing pipework;

  • inadequate water pressure supplied by utilities;

  • defects outside the scope of the Works.

 

9.4 Delays

Whilst every effort will be made to complete work within estimated timescales, Wimbledon Plumbing Services shall not be liable for delays caused by circumstances beyond its reasonable control.

 

9.5 Consequential Damage

Where work necessarily requires floors, walls, ceilings or other building elements to be opened to access concealed services, Wimbledon Plumbing Services will exercise reasonable care.

Unless caused by negligence, we shall not be responsible for the cost of redecorating, reinstatement or making good beyond that expressly included within our quotation.

 

9.6 Third-Party Contractors

Where the Customer appoints other contractors to work before, during or after our attendance, Wimbledon Plumbing Services accepts no liability for defects, delays or damage arising from their work.

 

9.7 Subcontractors

Wimbledon Plumbing Services may, where appropriate, engage suitably qualified subcontractors to carry out part or all of the Works.

Any subcontractor appointed by Wimbledon Plumbing Services shall be expected to maintain appropriate qualifications and insurance.

For the purposes of the contract with the Customer, Wimbledon Plumbing Services remains responsible for ensuring that the contracted Works are completed with reasonable skill and care.

 

9.8 Statutory Rights

Nothing within these Terms and Conditions shall exclude or restrict liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • breach of statutory rights under consumer protection legislation; or

  • any other liability that cannot lawfully be excluded or limited under the laws of England and Wales.

10. Cancellations and Consumer Rights

 

10.1 Customer Cancellation

The Customer may cancel or postpone the Works at any time by notifying Wimbledon Plumbing Services.

Where work has not yet commenced, any deposit paid shall be refunded less any reasonable costs already incurred, including but not limited to:

  • materials purchased specifically for the Works;

  • bespoke or non-returnable items;

  • specialist surveys;

  • third-party costs;

  • administrative costs reasonably incurred.

 

10.2 Cancellation During the Works

If the Customer instructs Wimbledon Plumbing Services to stop work after commencement, the Customer shall remain responsible for payment of:

  • all labour completed to the date of cancellation;

  • all materials supplied or ordered;

  • any reasonable costs arising from cancellation;

  • any third-party charges already committed.

Where applicable, Wimbledon Plumbing Services reserves the right to remove materials that remain its property, provided this can be carried out safely and without causing unnecessary damage.

 

10.3 Consumer Cancellation Rights

Where a contract is entered into away from Wimbledon Plumbing Services' business premises, or exclusively by telephone, email or other distance communication, the Customer may have cancellation rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Where these Regulations apply, the Customer will normally have the right to cancel within 14 days.

However, if the Customer requests that work begins during the cancellation period, they expressly acknowledge that:

  • they may become liable for payment for work carried out before cancellation;

  • where the service has been fully completed during that period with their agreement, the right to cancel may be lost.

Nothing in these Terms affects any statutory cancellation rights.

11. Complaints

 

11.1 Commitment to Quality

Wimbledon Plumbing Services is committed to providing a professional, courteous and high-quality service.

If the Customer is dissatisfied with any aspect of the Works, we ask that the issue is raised as soon as reasonably practicable to allow an opportunity to investigate and, where appropriate, resolve the matter.

 

11.2 Making a Complaint

Complaints should preferably be submitted in writing by email or letter and should include:

  • the Customer's name and address;

  • the property where the Works were carried out;

  • the invoice number (where available);

  • details of the complaint;

  • photographs where relevant.

 

11.3 Investigation

Wimbledon Plumbing Services will acknowledge receipt of the complaint within a reasonable time and will investigate the issues raised.

Where necessary, an inspection of the Property may be arranged.

The Customer agrees to provide reasonable access to enable the complaint to be investigated.

 

11.4 Opportunity to Rectify

Before engaging another contractor to carry out remedial work, the Customer shall provide Wimbledon Plumbing Services with a reasonable opportunity to inspect and, where appropriate, rectify any defect covered by these Terms.

Wimbledon Plumbing Services shall not be responsible for costs incurred by appointing another contractor without first being given this opportunity.

 

12. Data Protection

 

12.1 Personal Information

Wimbledon Plumbing Services collects and processes personal information only insofar as is necessary for:

  • providing quotations;

  • carrying out the Works;

  • issuing invoices;

  • maintaining warranty records;

  • complying with legal obligations.

Personal information will be processed in accordance with applicable UK data protection legislation.

 

12.2 Storage of Information

Records relating to quotations, invoices, certificates and correspondence may be retained for legal, accounting and warranty purposes.

Appropriate measures will be taken to safeguard personal information.

 

12.3 Photographs

Wimbledon Plumbing Services may take photographs before, during and after the Works for purposes including:

  • record keeping;

  • technical reference;

  • warranty evidence;

  • insurance requirements;

  • quality assurance.

Photographs will not intentionally identify the Customer or reveal personal information without consent, except where required by law or for the defence of legal proceedings.

Separate permission will always be sought before any photograph is used for marketing or promotional purposes.

 

13. Force Majeure

Wimbledon Plumbing Services shall not be liable for any delay or failure to perform its obligations where such delay or failure arises from circumstances beyond its reasonable control.

Examples include, but are not limited to:

  • severe weather;

  • flooding;

  • fire;

  • epidemic or pandemic;

  • industrial action;

  • shortage of labour;

  • supplier failure;

  • transport disruption;

  • utility interruption;

  • government restrictions;

  • acts of terrorism;

  • civil unrest;

  • natural disasters.

Where reasonably practicable, Wimbledon Plumbing Services will notify the Customer of any delay and make reasonable efforts to resume the Works as soon as possible.

14. Assignment and Subcontracting

 

Wimbledon Plumbing Services may appoint suitably qualified employees or subcontractors to carry out all or part of the Works.

The Customer may not assign or transfer the contract without the prior written consent of Wimbledon Plumbing Services.

 

15. Entire Agreement

 

These Terms and Conditions, together with any accepted quotation, specification or written agreement, constitute the entire agreement between Wimbledon Plumbing Services and the Customer.

They supersede all previous discussions, negotiations or representations relating to the Works.

No variation shall be effective unless confirmed in writing by Wimbledon Plumbing Services.

 

16. Severability

 

If any provision of these Terms is held by a court or other competent authority to be unlawful, invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Where possible, any invalid provision shall be interpreted so as to give effect to its original commercial purpose.

 

17. Waiver

 

Failure by Wimbledon Plumbing Services to enforce any right or provision of these Terms shall not constitute a waiver of that right.

Any waiver must be made expressly and in writing.

 

18. Notices

 

Any notice required under these Terms may be given by:

  • email;

  • first-class post;

  • personal delivery; or

  • any other method agreed between the parties.

Notices shall be deemed received:

  • immediately where delivered by hand;

  • two working days after posting by first-class mail;

  • on the day of transmission where sent by email before 5.00 pm on a working day, otherwise on the next working day.

 

19. Governing Law and Jurisdiction

 

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
